1. Purpose

This Acceptable Use Policy (Policy) forms part of and is incorporated into the Terms of Service governing your access to and use of the LPM platform operated by Lift Portfolio Management Pty Ltd (ABN 55 699 041 391) (LPM, we, us, our) (Platform). By accessing or using the Platform, you agree to comply with this Policy and acknowledge that a breach of this Policy may constitute a breach of the Terms of Service.

2. Acceptable use

You may access and use the Platform only for lawful purposes and in accordance with the intended functionality of the Platform, the Terms of Service and this Policy.

3. Prohibited conduct

You must not, and must not permit any other person to:

  • use the Platform for any unlawful, fraudulent, harmful or misleading purpose;
  • breach any applicable law, regulation, confidentiality obligation, or third-party right in connection with your use of the Platform;
  • attempt to gain unauthorised access to the Platform, other accounts, or our systems or networks;
  • introduce viruses, malware, malicious code or other harmful material into the Platform;
  • reverse engineer, decompile, disassemble, copy, or otherwise attempt to derive the source code or underlying technology of the Platform except to the extent permitted by law;
  • interfere with, disrupt, impair, or test the integrity or performance of the Platform, including through activity that adversely affects performance, scraping, denial-of-service activity, or circumvention of technical controls;
  • resell, sublicense, share access to, or otherwise make the Platform available to third parties without our prior written consent;
  • rely on, or represent to any third party, the Platform's analysis, risk flags, or other outputs as professional, legal, engineering, certification, compliance, or other expert advice, or use those outputs as a substitute for independent verification, professional judgement, or obtaining appropriate independent advice; or
  • upload or store sensitive information except where reasonably necessary for legitimate use of the Platform and permitted under applicable law.

4. Content standards

You are responsible for all User Content you upload to the Platform.

User Content must be lawful and must not infringe the intellectual property rights, privacy rights, confidentiality obligations, or other rights of any third party.

You must hold all rights, permissions, and consents necessary to upload, store, process, and use User Content on the Platform.

In particular, you must not upload documents or information belonging to or authored by a third party — including contracts, quotations, or correspondence from contractors or suppliers — unless you have all rights, permissions, consents, and authority reasonably necessary to disclose that material to us and permit its processing through the Platform.

5. Enforcement

Where we reasonably believe that you have breached this Policy, or where reasonably necessary to protect the Platform, other users, or comply with applicable law, we may take proportionate enforcement action, including:

  • issuing a warning;
  • removing, disabling access to, or restricting User Content to the extent reasonably necessary;
  • suspending or limiting access to the Platform; or
  • terminating your Account in accordance with the Terms of Service.

Where reasonably practicable, we will provide notice of enforcement action.

6. Reporting misuse

To report a suspected breach of this Policy or any suspected misuse of the Platform, please contact us at legal@liftportfoliomanagement.com.au.

7. Changes to this Policy

We may update this Policy from time to time.

Material changes to this Policy will be communicated in accordance with the Terms of Service. Non-material changes may take effect from the date the updated Policy is published on the Platform.

Your continued access to or use of the Platform after any updated Policy takes effect constitutes acceptance of the updated Policy.
